1. Agreement to these Terms

These Terms of Service (“Terms”) are a binding agreement between you and VinAccuracy (“we,” “us” or “our”). They govern your use of our website, vehicle history reports, membership and any related services (together, the “Services”). By using the Services, creating an account or starting a membership, you agree to these Terms, our Privacy Policy and the NMVTIS Consumer Access Product Disclaimer.

Please read the Dispute Resolution section carefully. It requires most disputes to be resolved through individual arbitration and waives your right to a jury trial or to take part in a class action, unless you opt out.

2. The Services

We compile vehicle information associated with a Vehicle Identification Number (VIN) you provide into a report. Depending on the vehicle and the data available, a report may include factory specifications, title brands, salvage and total-loss records, reported odometer readings, sale and listing history, market values, safety recalls, owner complaints and crash test ratings. Some sections, such as recalls, complaints and crash ratings, describe the vehicle's year, make and model rather than the individual vehicle, and are labelled that way.

We grant you a limited, personal, non-exclusive, non-transferable and revocable license to access and use the Services and reports for your own evaluation of a vehicle, subject to these Terms.

A report is not a substitute for a pre-purchase inspection by a qualified mechanic, a test drive or a review of the vehicle's paperwork.

3. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Services. You agree to give us accurate information, including a working email address that you control.

We sign you in with single-use links sent to your email address. You are responsible for keeping access to that inbox secure and for activity on your account. Tell us promptly through our Contact Us page if you believe someone has accessed your account without permission.

4. Electronic Communications

By creating an account you agree that we may communicate with you electronically, and that electronic notices, disclosures and agreements satisfy any legal requirement that they be in writing. We will send service messages such as sign-in links, receipts, renewal reminders, refund confirmations and changes to these Terms to the email address on your account.

Service messages are part of the membership and cannot be turned off while your account is open, though you can close your account at any time. If we ever send optional marketing email, every message will include an unsubscribe link, and unsubscribing will not affect the service messages above. We do not send marketing text messages, and we do not share your contact details with partner marketers.

5. Membership, Pricing and Billing

Plans. We offer the following monthly memberships. Every plan includes the same report; they differ only in how many new VINs you may run each month.

  • Starter — $30.00 per month for up to 5 reports on new VINs. New members start with 1 vehicle report and 7 days of access for $1.00.
  • Basic — $15.00 per month for up to 2 reports on new VINs. Billed in full on the day you start it.
  • Standard — $30.00 per month for up to 5 reports on new VINs. Billed in full on the day you start it.
  • Plus — $50.00 per month for up to 10 reports on new VINs. Billed in full on the day you start it.
  • Pro — $120.00 per month for up to 30 reports on new VINs. Billed in full on the day you start it.

Introductory period (Starter only). When you start the Starter plan we charge $1.00 (plus any applicable sales tax) immediately. This gives you 1 vehicle report and 7 days of access. The other plans carry no introductory offer and are charged in full when you start them.

Automatic renewal. Every plan renews automatically. On the Starter plan, unless you cancel before the introductory period ends, your membership converts to a monthly subscription charged on the day that period ends and on the same day each month after that. On the other plans the same monthly fee is charged on the day you start and each month after that. Renewals continue until you cancel. Unused reports do not roll over, and re-opening a report you have already run is free and does not count toward your limit.

Changing plans. Your plan is chosen when you subscribe. To move to a different plan, cancel your current membership and start the one you want.

Billed in advance. Subscription fees are billed at the start of each period. We send a receipt by email for every charge and a reminder before your first monthly renewal.

Authorization. By starting a membership you authorize us and our payment processor to store your payment method and charge it for all fees described above. Charges appear on your statement as VINACCURACY.

Price changes. We may change our prices or plan features. We will tell you by email at least 30 days before any price increase takes effect for your membership, and the new price will apply from your next billing date after that notice. You can cancel before then if you do not accept the change.

Failed payments. If a charge fails, we may retry it and may suspend access to new reports until payment succeeds or you cancel. We do not add a fee for a failed or retried payment.

Billing errors. Check your receipts and card statements. If you think we have charged you in error, contact us through our Contact Us page within 60 days of the charge and we will investigate and correct any mistake we find. This does not limit any chargeback or dispute rights you have with your card issuer or bank.

6. Cancellation

You can cancel at any time, for any reason, by clicking “Cancel” on your account page. It takes one click. You may also cancel by contacting us through our Contact Us page.

Cancellation stops all future charges. To avoid being charged for the next period, you must cancel before your next billing date. After you cancel, you keep access until the end of the period you have already paid for.

7. Refunds and Money-Back Guarantee

If a report cannot be generated for your VIN, or you are unhappy with your first report for any reason, contact us within 7 days of the charge and we will refund that charge in full.

Otherwise, monthly subscription fees are billed in advance and are non-refundable, and we do not provide refunds or credits for partial periods or unused reports, except where required by law.

9. Prohibited Uses

You agree not to:

  • resell, redistribute, publish or sublicense reports or report data;
  • use bots, scrapers or other automated means to access the Services or extract data;
  • share your account, or use it to run reports on behalf of a business or third parties without a separate written agreement with us;
  • use the Services to locate, identify, contact or harass any person, or for any purpose prohibited by the Driver's Privacy Protection Act;
  • use any report as a factor in decisions about a person's credit, insurance, employment, housing or other eligibility governed by the Fair Credit Reporting Act;
  • use the Services for any fraudulent or unlawful purpose, including misrepresenting a vehicle's history to a buyer;
  • interfere with, probe or attempt to gain unauthorized access to the Services, our systems or other users' accounts, or introduce malware;
  • copy, modify or reverse engineer any part of the Services; or
  • use the Services in violation of any applicable law, including export and sanctions laws.

10. FCRA Notice

We are not a “consumer reporting agency” as defined by the Fair Credit Reporting Act (FCRA), and our reports are not “consumer reports.” Reports describe vehicles, not people. You may not use the Services or any information from them to determine a person's eligibility for credit, insurance, employment, housing or any other purpose covered by the FCRA. If you do, you may be liable under federal and state law.

11. DPPA and Personal Information

Our reports do not include the names, addresses or other personal information of current or past vehicle owners. The Driver's Privacy Protection Act (18 U.S.C. § 2721 et seq.) restricts how personal information from state motor vehicle records may be obtained and used, and violations can carry criminal fines and civil liability. You agree not to use the Services in an attempt to obtain such information.

12. NMVTIS Data

Title, brand, odometer, salvage and total-loss information from the National Motor Vehicle Title Information System (NMVTIS) is provided through an approved data provider and is subject to the NMVTIS Consumer Access Product Disclaimer, which explains what NMVTIS does and does not contain.

13. Business and API Use

Memberships are for individual use. Dealers, lenders, marketplaces and other businesses that want to run reports at volume or access data through an API need a separate written agreement with us. Contact us to discuss business terms.

14. Intellectual Property

The Services, including their design, text, graphics, software and the selection and arrangement of report data, are owned by us or our licensors and protected by intellectual property laws. Except for the limited license in these Terms, no rights are granted to you. Our name and logo are our trademarks and may not be used without permission.

15. Copyright Complaints

We respect copyright. If you believe material on the Services infringes a copyright you own or represent, send us a notice through our Contact Us page with: your contact details; identification of the work you say is infringed; the location of the material on our site; a statement that you believe in good faith that the use is not authorized by the copyright owner or the law; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We respond to valid notices under the Digital Millennium Copyright Act, including by removing material, and we may terminate the accounts of repeat infringers.

16. Third-Party Data and Links

Reports rely on data from government agencies and commercial data providers that we do not control. The Services may also link to third-party websites. We are not responsible for third-party content, products or practices, and your dealings with third parties are solely between you and them.

17. Data Accuracy and Disclaimers

We work to present data accurately, but we depend on the completeness and accuracy of the records reported to our sources. Records may be missing, delayed or wrong, and not every event in a vehicle's life is reported to any database. The absence of a record in a report does not mean that an event, such as an accident, flood or title brand, did not happen. You are responsible for independently verifying information that matters to your decision.

The Services and all reports are provided “as is” and “as available,” with all faults and without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy and uninterrupted availability, to the fullest extent permitted by law.

18. Limitation of Liability

To the fullest extent permitted by law, we and our officers, employees, licensors and data providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to the Services or these Terms, even if we have been advised of the possibility of such damages.

Our total liability for all claims arising out of or related to the Services or these Terms will not exceed the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or $100.

Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.

19. Indemnification

You agree to defend, indemnify and hold us harmless from any claims, losses, liabilities and expenses (including reasonable attorneys' fees) arising from your misuse of the Services, your violation of these Terms or your violation of any law or the rights of a third party.

20. Suspension and Termination

We may suspend or terminate your access if you violate these Terms, if required by law, or if we stop offering the Services. If we terminate your membership for a reason other than your violation of these Terms, we will refund the unused portion of any fees you have prepaid. Sections that by their nature should survive termination, including those on fees owed, disclaimers, limitation of liability, indemnification and dispute resolution, will survive.

21. Dispute Resolution and Arbitration

Talk to us first. Most concerns can be resolved quickly through customer support. Before starting a formal proceeding, you and we each agree to try to resolve the dispute informally for at least 30 days after written notice.

Binding arbitration. If a dispute is not resolved informally, you and we agree that it will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Either party may instead bring an individual claim in small claims court if it qualifies. Nothing here prevents either party from seeking injunctive relief for misuse of intellectual property.

Class action waiver. You and we agree that claims may be brought only on an individual basis, and not as a plaintiff or class member in any class, consolidated or representative proceeding. You and we each waive the right to a jury trial.

Opting out. You may opt out of this arbitration agreement by sending us a message through our Contact Us page within 30 days of first accepting these Terms, stating your name, email address and that you opt out of arbitration. Opting out does not affect any other part of these Terms.

22. Governing Law

These Terms are governed by the Federal Arbitration Act and, to the extent not preempted, by the laws of the state in which we are organized, without regard to conflict-of-law rules. This does not deprive you of any protection given to you by the consumer protection laws of the state where you live.

23. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Services before they take effect. Changes will not apply retroactively, and changes to fees are handled as described in Membership, Pricing and Billing. Continuing to use the Services after the changes take effect means you accept them.

24. Notices

We give you notice by email to the address on your account, or by posting in the Services, and a notice is treated as received on the day it is sent. Keep your email address current, and check that our messages are not being filtered as spam, because renewal reminders and receipts go there. You give us notice through our Contact Us page.

25. General

These Terms, together with the policies they reference and the purchase terms you accept at checkout, are the entire agreement between you and us about the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Nothing in these Terms creates a partnership, agency or employment relationship.
